The question to ask before signing, and what the law says about what they can charge you

Pedir dinero prestado no es bueno ni malo en sí mismo: depende de para qué es y de lo que te va a costar. Esta ficha da un criterio para distinguir el crédito que puede tener sentido del que casi siempre es una trampa, y explica qué puede cobrarte legalmente un banco cuando quieres cancelar o amortizar anticipadamente.

Borrowing money isn't good or bad in itself: it depends on what it's for and what it's going to cost you. This guide gives a criterion for telling apart credit that can make sense from credit that's almost always a trap, and explains what a bank can legally charge you when you want to cancel or prepay early.

¿Esta deuda financia algo que va a generar más valor del que cuesta el crédito (una vivienda que necesitas y puedes pagar, una formación con salida clara, un negocio con ingresos ya probados), o financia un consumo que se deprecia o desaparece en cuanto lo usas? Does this debt finance something that will generate more value than the credit costs (a home you need and can afford, training with a clear career path, a business with already-proven income), or does it finance consumption that depreciates or disappears the moment you use it?
CUÁNDO PUEDE TENER SENTIDO WHEN IT CAN MAKE SENSE Hipoteca para vivienda habitual, con cuota sostenible. Financiar formación o negocio con retorno esperado claro y capacidad de pago ya demostrada, no proyectada. Refinanciar deuda cara por deuda barata (nunca al revés). Una regla práctica para la cuota

Para una hipoteca o cualquier deuda a largo plazo, una referencia habitual es que la cuota no supere el 30-35 % de tus ingresos netos mensuales, sumando todas las deudas que ya tengas. Por encima de eso, cualquier imprevisto (los del fondo de emergencia de la Ficha 00) te puede dejar sin margen real.

For a mortgage or any long-term debt, a common reference is that the payment shouldn't exceed 30-35% of your net monthly income, adding up all debts you already have. Above that, any setback (the kind Guide 00's emergency fund covers) can leave you with no real breathing room.

Por qué el revolving es la trampa más extendida

Why revolving credit is the most widespread trap

Una tarjeta revolving no exige pagar toda la deuda cada mes: paga solo un porcentaje mínimo (a menudo entre el 3 % y el 5 %). El problema es que ese mínimo apenas cubre los intereses, así que el capital pendiente baja muy despacio — se puede estar años pagando una cuota cómoda sin que la deuda desaparezca, con TAE que suelen moverse muy por encima del interés de un préstamo personal normal.

A revolving card doesn't require paying off all the debt each month: it only requires a minimum percentage (often 3% to 5%). The problem is that minimum barely covers the interest, so the outstanding capital drops very slowly — you can spend years paying a comfortable installment without the debt disappearing, with APRs usually far above a normal personal loan.

UN DATO QUE CONVIENE CONOCER SOMETHING WORTH KNOWING El Tribunal Supremo ha fijado un criterio de referencia: cuando el interés pactado supera en más de 6 puntos porcentuales la TAE media del Banco de España para un producto comparable, puede considerarse "notablemente superior al normal" y, por tanto, usurario. Un contrato declarado usurario se anula: el cliente devuelve solo el capital prestado, sin intereses ni comisiones. Esto no es automático — hay que reclamarlo — pero es un criterio real que ya se ha aplicado también a préstamos personales, no solo a tarjetas. Spain's Supreme Court has set a reference criterion: when the agreed interest rate exceeds the Bank of Spain's average APR for a comparable product by more than 6 percentage points, it can be considered "notably higher than normal" and therefore usurious. A contract ruled usurious is voided: the customer repays only the borrowed capital, with no interest or fees. This isn't automatic — you have to claim it — but it's a real criterion that has already been applied to personal loans too, not just cards.

Adelantar capital de un préstamo reduce los intereses totales que vas a pagar, porque estos se calculan sobre lo que queda pendiente. La duda habitual es cuánto puede cobrarte el banco por eso. Para hipotecas firmadas desde 2019 (Ley 5/2019), los topes legales son estos:

Prepaying capital on a loan reduces the total interest you'll pay, because it's calculated on what's still outstanding. The usual question is how much the bank can charge you for that. For mortgages signed since 2019 (Law 5/2019), these are the legal caps:

Además, la ley pone un techo adicional: en ningún caso la comisión puede superar la pérdida financiera real que sufra el banco por el adelanto. Para préstamos personales (no hipotecarios), los límites habituales son distintos y conviene revisarlos en el contrato — la ley de crédito al consumo también limita esta comisión, normalmente a un porcentaje muy inferior.

The law also sets an additional ceiling: the fee can never exceed the bank's actual financial loss from the prepayment. For personal loans (non-mortgage), the usual limits are different and should be checked in the contract — consumer credit law also caps this fee, usually to a much lower percentage.

CHECKLIST ANTES DE FIRMAR CUALQUIER CRÉDITO CHECKLIST BEFORE SIGNING ANY CREDIT Compara la TAE, no el interés nominal: la TAE incluye comisiones y es lo único comparable entre ofertas. Pregunta explícitamente por la comisión de amortización anticipada y de cancelación antes de firmar, no cuando quieras cancelar. Si el crédito es para invertir (bolsa, cripto, negocio), asume que puedes perder el capital invertido Y seguir debiendo el préstamo entero. Ninguna oferta que solo esté disponible "si firmas ahora mismo" es una buena oferta. Compare the APR, not the nominal rate: the APR includes fees and is the only thing truly comparable between offers. Explicitly ask about the prepayment and cancellation fees before signing, not when you want to cancel. If the credit is for investing (stocks, crypto, a business), assume you can lose the invested capital AND still owe the entire loan. No offer that's only available "if you sign right now" is a good offer.

Pide crédito solo para lo que genera más valor del que cuesta, compara siempre la TAE, y ten en cuenta que la ley limita lo que un banco puede cobrarte por cancelar o amortizar antes de tiempo — aunque no siempre te lo apliquen sin que lo reclames.

Only borrow for what generates more value than it costs, always compare the APR, and remember the law limits what a bank can charge you for cancelling or prepaying early — though it isn't always applied without you claiming it.
