Esta ficha no busca convencerte de nada. Busca que entiendas qué compras cuando compras una criptomoneda, qué ha cambiado en su regulación en España, y por qué el tope del 5 % de la Ficha 01 no es prudencia excesiva, sino la forma correcta de pensar el riesgo de un activo tan volátil.

This guide isn't trying to convince you of anything. It's trying to make sure you understand what you're buying when you buy a cryptocurrency, what's changed in its regulation in Spain, and why the 5% cap from Guide 01 isn't excessive caution — it's the correct way to think about the risk of such a volatile asset.

Qué es (y qué no es) una criptomoneda

What a cryptocurrency is (and isn't)

Una acción representa una parte de un negocio real con ingresos, costes y beneficios (o pérdidas). Un bono es un préstamo con un interés pactado. Una criptomoneda no genera flujo de caja propio: su precio depende enteramente de cuánta gente quiera comprarla o venderla en cada momento, y de las expectativas sobre su uso futuro. Eso no la hace "falsa" ni "una estafa" por definición — pero sí explica por qué su precio puede moverse un 20-30 % en una semana sin que haya cambiado nada en sus fundamentos, porque en sentido estricto no tiene fundamentos económicos que analizar del mismo modo que una empresa.

A stock represents a share of a real business with revenue, costs and profits (or losses). A bond is a loan with an agreed interest rate. A cryptocurrency doesn't generate its own cash flow: its price depends entirely on how many people want to buy or sell it at any given moment, and on expectations about its future use. That doesn't make it "fake" or "a scam" by definition — but it does explain why its price can move 20-30% in a week with nothing having changed in its fundamentals, because strictly speaking it has no economic fundamentals to analyze the way a company does.

MiCA: the regulation that changes the rules

Desde julio de 2026, el reglamento europeo MiCA (Markets in Crypto-Assets) está plenamente en vigor en España. La CNMV supervisa ahora directamente a las plataformas de criptoactivos (exchanges), no solo para prevenir blanqueo de capitales, sino también su solvencia y la protección de los fondos de los clientes.

Since July 2026, the European MiCA regulation (Markets in Crypto-Assets) has been fully in force in Spain. The CNMV (Spain's securities regulator) now directly supervises crypto-asset platforms (exchanges) — not just to prevent money laundering, but also their solvency and the protection of client funds.

Cualquier plataforma que opere en España sin autorización de la CNMV debe suspender su actividad. Usar un exchange no autorizado dejó de ser "una opción arriesgada pero legal" para pasar a ser, directamente, usar una plataforma fuera de la ley en España — y sin la protección de fondos segregados que exige MiCA a las autorizadas. Any platform operating in Spain without CNMV authorization must suspend its activity. Using an unauthorized exchange is no longer "a risky but legal option" — it's now, directly, using a platform operating outside the law in Spain, without the segregated-funds protection MiCA requires of authorized platforms.

En la práctica, esto significa comprobar que la plataforma que usas está autorizada bajo MiCA antes de depositar un euro — no es un trámite menor, es lo que decide si tus fondos están legalmente protegidos si la plataforma quiebra.

In practice, this means checking that the platform you use is authorized under MiCA before depositing a single euro — it's not a minor formality, it's what determines whether your funds are legally protected if the platform collapses.

La ganancia tributa dentro de la base del ahorro, con los mismos tramos del 19 % al 30 % de la Ficha 09. Mientras no vendas, canjees ni gastes, no hay ganancia que declarar — mantener una posición sin moverla no genera impuesto por sí solo.

The gain is taxed within the savings tax base, with the same 19-30% brackets from Guide 09. As long as you don't sell, swap or spend, there's nothing to declare — simply holding a position doesn't generate tax on its own.

El modelo 721: la obligación que se olvida

Declaración de criptomonedas en el extranjero Declaring cryptocurrency held abroad Obligatoria si tienes criptomonedas custodiadas por un tercero (un exchange) fuera de España y su valor conjunto supera 50.000 € a 31 de diciembre. En años siguientes, hay que volver a declarar si el valor sube en más de 20.000 € respecto a la última declaración. Se presenta entre el 1 de enero y el 31 de marzo del año siguiente. Si guardas tus criptomonedas en un wallet propio (self-custody, sin intermediario), esta obligación concreta no aplica — pero la ganancia sigue tributando igual el día que las vendas o las canjees. Mandatory if you hold cryptocurrency custodied by a third party (an exchange) outside Spain and its combined value exceeds €50,000 as of December 31st. In following years, you must declare again if the value rises by more than €20,000 compared to your last filing. It's filed between January 1st and March 31st of the following year. If you hold your crypto in a self-custody wallet (no intermediary), this specific obligation doesn't apply — but the gain is still taxed the same way the day you sell or swap it.

El límite no sube con el patrimonio: sigue siendo un máximo del 5 % en cualquier tramo a partir del 3, y del 0 % en los Tramos 1 y 2, donde ni siquiera se ha completado el fondo de emergencia o empezado a invertir de forma diversificada. La razón no cambia: ese 5 % debe ser, siempre, la cantidad que puedes permitirte perder por completo sin que tu situación financiera cambie — nunca una apuesta por "cuánto crees que va a subir".

The cap doesn't rise with your wealth: it stays a maximum of 5% at any bracket from 3 upward, and 0% in Brackets 1 and 2, where you haven't even finished your emergency fund or started investing in a diversified way. The reasoning doesn't change: that 5% should always be the amount you can afford to lose completely without your financial situation changing — never a bet on "how much you think it'll go up".

Cryptocurrencies are no longer lawless territory in Spain — a platform is either authorized or it isn't, and a gain is either declared or hidden by mistake — but being legal doesn't make them any less volatile: the 5% cap isn't conservative advice, it's the arithmetic of an acceptable loss.
