Hacienda sin sustos

Taxes without surprises

The minimum you need to understand about income tax, withholdings, and what happens if you're late

Fear of the tax authorities almost always comes from not understanding how it works, not from it being especially complicated once you see the mechanism. This guide covers the basics: how income tax is really calculated, what withholdings are (and why they're not the final tax), and exactly what happens if you're late on a payment.

El malentendido más extendido sobre el IRPF

The most common misunderstanding about income tax

"If I earn more and move up a bracket, I lose net money" is false. Income tax is progressive by bracket: each slice of your income is taxed at its own rate, not all your money at the highest rate you reach. Earning more always leaves you with more net money, even though an additional slice is taxed at a higher rate.

Los tramos estatales del IRPF general en 2026

The state income-tax brackets in 2026

Base liquidable generalTaxable baseTipo marginal estatalState marginal rate
Hasta 12.450 €Up to €12,45019 %
12.450 € – 20.200 €€12,450 – 20,20024 %
20.200 € – 35.200 €€20,200 – 35,20030 %
35.200 € – 60.000 €€35,200 – 60,00037 %
60.000 € – 300.000 €€60,000 – 300,00045 %

This is only the state portion. Each autonomous region adds its own bracket on top of the state one — that's why the final rate varies depending on where you live, and these figures aren't the total actually paid. Don't confuse this with the savings tax base (interest, dividends, investment gains), which has its own 19-30% table — see Guide 01.

What withholdings are (and why they're almost never the final tax)

A withholding is an advance payment on account of the tax, not the tax itself. Whoever pays you (your employer, your bank, a client) withholds a percentage and pays it directly to the tax authorities on your behalf; on your annual return, what was withheld is compared to what you actually owe based on your total income, and the difference is refunded or paid.

El modelo 130: el pago fraccionado del autónomo

Form 130: the freelancer's installment payment

A freelancer under direct estimation doesn't wait for the annual return to pay: they file Form 130 every quarter, an installment payment on account of the year's income tax. The simplified calculation is 20% of net earnings accumulated since January, minus installment payments and withholdings already made in prior quarters.

Am I required to file a tax return?

There are thresholds below which, generally, filing isn't mandatory if you only have employment income — but they change each tax year and depend on whether you have one or several payers, so the exact figure needs checking each campaign, not assumed from year to year. Even without an obligation, it sometimes pays to file anyway if it results in a refund (for example, if too much was withheld).

What happens if you don't pay on time: enforcement-period surcharges

Once the voluntary payment deadline passes without paying or requesting a deferral, the tax authorities apply increasing surcharges — the sooner you react, the less you pay:

RecargoSurchargePorcentajePercentageCuándo se aplicaWhen it applies
Recargo ejecutivoEnforcement surcharge5 %Pagas la deuda completa antes de que te notifiquen la providencia de apremioYou pay the full debt before being notified of the enforcement order

Apremio ordinarioOrdinary distraint20 % + intereses20% + late-payment interestNo pagas dentro de ese plazo — puede derivar en embargoYou don't pay within that deadline — can lead to asset seizure

The way out almost no one asks for in time: deferral

You can request to defer or split a debt owed to the tax authorities within the voluntary payment period, before enforcement-period surcharges begin. It carries late-payment interest, but that's much lower than the 20% ordinary distraint surcharge. Asking in time is almost always better than doing nothing and waiting for the notice to arrive — the difference between a 5% and a 20% surcharge depends, literally, on acting before or after.
Checklist para no llevarse sustos Checklist to avoid nasty surprises

Set aside a percentage of any income not subject to withholding (or with low withholding), already thinking about the income tax you'll owe — don't spend that money as if it were real net income. If you're a freelancer, don't skip the quarterly Form 130: letting the debt pile up for the annual return only postpones the problem. If you see you won't be able to pay on time, request the deferral before it's due. Check each year, don't assume from one tax year to the next, the filing-obligation thresholds and brackets: they change with every budget law.
