What determines your tax residence (and why it's not as simple as "living abroad")
Hacienda considera que eres residente fiscal en España si se cumple cualquiera de estos criterios, no todos a la vez: pasas más de 183 días al año en territorio español (no necesariamente seguidos); tu principal centro de actividades o intereses económicos está en España, aunque pases menos días aquí; o, salvo prueba en contrario, si tu cónyuge no separado legalmente y tus hijos menores dependientes residen habitualmente en España. Mudarse "sobre el papel" sin que la realidad de tu vida (familia, negocio, activos) se mueva contigo no cambia tu residencia fiscal ante Hacienda — es una de las formas más comunes de acabar con un problema, no con un ahorro.
Spain's tax authority considers you a tax resident if any of these criteria are met, not all of them at once: you spend more than 183 days a year in Spanish territory (not necessarily consecutive); your main center of economic activity or interests is in Spain, even if you spend fewer days here; or, unless proven otherwise, your legally non-separated spouse and dependent minor children habitually reside in Spain. Moving "on paper" without the reality of your life (family, business, assets) moving with you doesn't change your tax residence in the eyes of the authorities — it's one of the most common ways to end up with a problem, not a saving.

El artículo 95 bis de la Ley del IRPF obliga a tributar por las plusvalías latentes (no vendidas, solo revalorizadas sobre el papel) de tus acciones y participaciones en el momento en que dejas de ser residente fiscal en España — como si las hubieras vendido justo antes de irte, aunque no lo hayas hecho. Aplica solo si, además, has sido residente fiscal en España al menos 10 de los últimos 15 años, y se activa con cualquiera de estos dos umbrales alternativos (no hay que cumplir los dos):
Article 95 bis of the Spanish Income Tax Law requires you to pay tax on unrealized gains (not sold, only revalued on paper) on your shares and holdings at the moment you stop being a Spanish tax resident — as if you had sold them right before leaving, even though you haven't. It only applies if, in addition, you've been a Spanish tax resident for at least 10 of the last 15 years, and it's triggered by either of these two alternative thresholds (you don't need to meet both):

Durante años, el Régimen de No Habitual Residente (NHR) portugués fue la referencia para españoles que se planteaban mudarse por motivos fiscales. Ese régimen clásico se cerró a nuevas solicitudes a finales de 2024 (con una fase transitoria hasta marzo de 2025) — quien ya estaba dentro conserva sus ventajas hasta completar sus 10 años, pero nadie puede acceder a él ya. Lo sustituye el IFICI ("NHR 2.0"), mucho más restringido: tipo fijo del 20 % sobre rendimientos del trabajo o de actividades profesionales cualificadas, pero solo para perfiles concretos — docencia e investigación científica, empleos altamente cualificados en empresas con beneficios fiscales, profesionales con doctorado o máster y varios años de experiencia, roles de I+D, o posiciones en startups certificadas. No es, como lo fue el NHR clásico, un régimen abierto a cualquier jubilado o rentista que se mude.
For years, Portugal's Non-Habitual Resident (NHR) regime was the go-to reference for Spaniards considering a move for tax reasons. That classic regime closed to new applications at the end of 2024 (with a transitional phase until March 2025) — those already inside keep their benefits until completing their 10 years, but nobody can access it anymore. It's been replaced by IFICI ("NHR 2.0"), much more restricted: a flat 20% rate on income from qualified work or professional activities, but only for specific profiles — teaching and scientific research, highly qualified jobs at companies with tax benefits, professionals with a doctorate or master's degree and several years of experience, R&D roles, or positions at certified startups. Unlike the classic NHR, it isn't a regime open to any retiree or rentier who relocates.

Entonces, ¿cuándo tiene sentido planteárselo de verdad?
So, when does it genuinely make sense to consider it?
Como orientación (no como regla): plantearse esto con seriedad empieza a tener sentido cuando el patrimonio en renta variable/participaciones se acerca a los umbrales del exit tax (sección 2), o cuando los ingresos anuales alcanzan tipos marginales del IRPF español que un cambio de residencia bien planificado y con sustancia real reduciría de forma significativa y sostenida — no de forma puntual un año. Por debajo de eso, el coste vital y económico de mudarse casi siempre supera el ahorro fiscal, y "me voy a Andorra" suele ser más una idea atractiva que un plan financiero real.
As a guideline (not a rule): seriously considering this starts to make sense when your equity/holdings wealth approaches the exit tax thresholds (section 2), or when annual income reaches Spanish marginal tax rates that a well-planned residence change with real substance would reduce significantly and sustainably — not just for one year. Below that, the personal and financial cost of relocating almost always outweighs the tax saving, and "I'm moving to Andorra" tends to be a more appealing idea than an actual financial plan.
